Part I: Terms & Conditions

1. Acceptance of Terms

1.1. This website (hereafter referred to as the "Site") is owned and operated by The SWAMP Academy (hereafter referred to as the "Academy").

1.2. By accessing, browsing, or using this Site, or by submitting an application form and paying the application fee, the applicant acknowledges that they have read, understood, and agreed to be bound by these Terms & Conditions. If you do not agree to these terms, you must cease using the Site immediately.

2. Website Use and Intellectual Property

2.1. Permitted Use: The content on this Site, including but not limited to text, software, graphics, logos, course descriptions, and multimedia material, is provided for informational and educational purposes only.

2.2. Proprietary Rights: All content, trademarks, and intellectual property displayed on the Site are the exclusive property of the Academy or its licensors. Unauthorized reproduction, distribution, modification, or commercial exploitation of any material on this Site without explicit written consent from the Academy is strictly prohibited.

3. Admission, Application Fees, and Seat Reservation

3.1. Application Fee: To initiate the enrollment process and request a seat reservation within a designated program batch, the Applicant must pay a pre-registration Application Fee of ₹1,999.

3.2. Admission Confirmation: Payment of the application fee reserves and confirms the applicant's seat in the selected program, subject to successful completion of any required documentation and compliance with academy policies. Final admission remains conditional upon the satisfaction of all eligibility criteria and the execution of the finalized tuition payment or installment agreement with the Academy admissions department.

4. Financial Transactions and Third-Party Payment Gateway

4.1. Authorized Processing: All electronic transactions, registration fees, and subsequent tuition installments are processed securely through our designated third-party payment gateway partner, Razorpay.

4.2. Authorization: By proceeding with the online transaction of the Application Fee or tuition installments, you authorize the Academy and Razorpay to charge your designated credit card, debit card, UPI handle, or net banking account.

4.3. Transactional Liability: The Academy is not responsible for transaction failures, network latencies, or processing surcharges levied by the Applicant’s issuing bank or financial institution. All such fees remain the sole responsibility of the account holder.

5. Integration with Refund Policy

5.1. Non-Refundable Fee: The application fee paid towards admission/enrollment at The SWAMP Academy is non-refundable under all circumstances, including withdrawal of application, non-selection, or failure to complete the admission process.

5.2. Transferability: Application fees are non-transferable and cannot be adjusted against any other course, batch, service, or applicant.

6. Limitation of Liability and Disclaimers

6.1. "As-Is" Provision: The Site and its contents are provided on an "as-is" and "as-available" basis without warranties of any kind, either express or implied, including the implied warranties of merchantability or fitness for a particular purpose.

6.2. Liability Cap: The Academy does not warrant that the functions contained in the Site will be uninterrupted or error-free. To the maximum extent permitted by applicable law, the Academy shall not be liable for any direct, indirect, incidental, or consequential damages resulting from the use or inability to use this Site.

7. Governing Law and Jurisdiction

7.1. These Terms & Conditions, your use of the Site, and all associated financial transactions or institutional processes shall be governed by and construed in accordance with the laws of the Republic of India.

7.2. Any legal disputes, claims, or litigation arising out of or in connection with these terms shall fall exclusively under the jurisdiction of the competent courts located in Mumbai, Maharashtra, India.

8. Modifications to Terms

8.1. The Academy reserves the right to modify, amend, or update these Terms & Conditions at any time without prior individual notice. All updates will be posted directly to this page with an updated "Last Updated" date, and continued use of the Site constitutes acceptance of the revised terms.

Part II: Refund & Cancellation Policy

1. Application & Registration Fee

1.1. To secure a seat reservation within a specific program batch, applicants are required to pay a pre-registration Application Fee of ₹1,999 (inclusive of payment gateway processing fees via Razorpay).

2. Refund and Transferability Restrictions

2.1. Non-Refundable Fee: The application fee paid towards admission/enrollment at The SWAMP Academy is non-refundable under all circumstances, including withdrawal of application, non-selection, or failure to complete the admission process.

2.2. Transferability: Application fees are non-transferable and cannot be adjusted against any other course, batch, service, or applicant.

3. Admission Confirmation & Tuition Schedules

3.1. Admission Confirmation: Payment of the application fee reserves and confirms the applicant's seat in the selected program, subject to successful completion of any required documentation and compliance with academy policies.

3.2. Tuition Balance Policies: Refund terms regarding full tuition balances, enrollment fees, or installment structures are governed solely by the individualized Enrollment Invoice Agreements executed during the formal online or offline admission consultation.

4.1. By submitting the application form and paying the application fee, the applicant acknowledges that they have read, understood, and agreed to these Terms & Conditions.

Part III: Privacy Policy

1. Information Collection and Categories of Data

The Academy collects only the necessary categories of personal data required to deliver its educational services, process applications, and maintain website functionality. This includes:

Identity and Contact Data: Legal first and last name, email address, telephone/mobile number, and city of residence. This includes any contact details voluntarily inputted into our online forms, fields, or inquiry panels, regardless of whether the form submission is fully completed or abandoned.

Academic and Program Data: Course preferences, program inquiries, and academic history submitted via forms.

Financial and Transaction Data: Payment gateway transaction reference IDs, transaction amounts, and payment timestamps related to the processing of the ₹1,999 Application Fee or tuition fees.

Technical, Cookie, and Usage Data: IP addresses, browser types, device identifiers, and usage metrics collected automatically via cookies, browser caching, and web analytics tools during your interaction with the Site.

2. Exclusion of Sensitive Financial Records

2.1. All electronic transaction processing is handled directly by our third-party payment gateway partner, Razorpay.

2.2. The Academy does not store, record, or retain raw financial credentials, including credit/debit card numbers, CVVs, expiration dates, UPI pins, or net banking passwords on its servers. All such data is encrypted and processed entirely within Razorpay’s secure infrastructure.

3. Purpose of Data Processing & Communication Consent

The Academy processes personal data under strict legal and institutional bases, specifically for the following purposes:

Administration & Evaluation: Reviewing admissions eligibility, allocating students to program batches, and verifying program attendance.

Transaction Verification: Processing and reconciling the non-refundable ₹1,999 Application Fee and subsequent tuition installments via Razorpay.

Institutional Communications: Conducting follow-ups, pre-admission callbacks, and scheduling updates. By inputting your contact coordinates on the Site, you expressly consent to be contacted by the Academy's admissions team via voice calls, SMS, WhatsApp, or email, even if your phone number is registered on a National Do Not Call (NDNC) registry.

Legal Compliance: Maintaining standard institutional records, accounting logs, and financial tax books.

4. Form Abandonment and Cached Data Tracking

4.1. Partial Data Capture: The Site may use real-time tracking scripts to capture contact information entered into our application or inquiry forms before you click the final "Submit" button. If you leave or close the Site without completing your registration, this data may be retained in order for the Academy to contact you to offer technical assistance or complete your application.

4.2. Cookies and Cache: We use standard browser caching and cookies to track your preferences, remember your form progress, and optimize website performance. Users can configure their local browser settings to decline cookies or clear cached data at any time, though doing so may cause certain form features to reset.

5. Third-Party Data Sharing and Payment Security

5.1. No Commercial Trading: The Academy does not sell, lease, trade, or rent user personal data to third-party marketing companies.

5.2. Service Providers: Data is shared with trusted third-party service providers (such as payment gateways and secure cloud hosting infrastructure) strictly to execute necessary backend operations.

5.3. Data Encryption: Financial transactions are secured via Secure Sockets Layer (SSL) encryption protocols and comply fully with the Payment Card Industry Data Security Standard (PCI-DSS).

6. Data Retention and Deletion Rights

6.1. Retention Period: Personal data is retained only for the duration necessary to fulfill the operational purposes detailed in Section 3, or as required to satisfy statutory legal, accounting, and institutional bookkeeping mandates.

6.2. Data Subject Rights: Users maintain the right to review, update, or correct inaccuracies within their recorded personal information. Requests to restrict processing or remove records from active student databases must be formally submitted to the Academy's administration email address provided below.

7. Legal and Statutory Disclosures

The Academy reserves the right to disclose personal data to law enforcement, regulatory bodies, or judicial authorities if explicitly mandated by a subpoena, court order, or governmental directive within the territory of India, or when deemed strictly necessary to prevent fraud, identity theft, or security vulnerabilities.

8. Policy Amendments

The Academy reserves the right to update this Privacy Policy at any time to reflect changing operational practices or statutory regulations. Any structural updates will be published immediately on this page with a revised "Last Updated" date.

9. Acceptance of Terms

9.1. By submitting the application form and paying the application fee, the applicant acknowledges that they have read, understood, and agreed to this Privacy Policy along with the comprehensive website Terms & Conditions.

Payment Details & Schedule

This document outlines the Reservation Fee, the admission discussion process, and the conditions for securing a seat at The SWAMP Academy. All prospective students are required to follow this process to complete their enrolment.

ENROLMENT JOURNEY

STEP 1: Apply & Pay Fee

Submit your application and pay the non-refundable Reservation Fee of INR 1,999 to begin your admission journey.

STEP 2: We Reach Out

The SWAMP Academy team gets in touch to discuss your goals, course options and answer your questions.

STEP 3: Offer of Admission

Upon confirmation, you receive a formal Offer of Admission from The SWAMP Academy.

STEP 4: Secure Your Seat

Pay the full Course Fee within 30 days of receiving your Offer of Admission to lock in your seat.

1.1 The Reservation Fee of INR 1,999 is payable at the time of submitting an application to The SWAMP Academy.

1.2 The Reservation Fee is non-refundable and non-transferrable under all circumstances, including withdrawal of application, non-selection, or failure to complete enrolment.

1.3 Upon successful selection and confirmation of admission, the Reservation Fee of INR 1,999 will be adjusted (credited) against the total Course Fee payable.

1.4 If the application is not selected, the Reservation Fee will not be refunded.

2. Seat Confirmation & Course Fee Payment

SEAT CONFIRMATION DEADLINE: Full Course Fee must be paid within 30 days of the Offer of Admission.

2.1 Upon receiving the Offer of Admission, students must pay the full Course Fee within thirty (30) calendar days to secure their seat in the batch. Prior to the Offer of Admission, the Academy team will reach out to discuss course options and confirm suitability.

2.2 Seats are limited and allocated on a first-come, first-served basis. Receipt of an Offer of Admission does not guarantee a seat until full payment is received.

2.3 If the full Course Fee is not received within 30 days of the Offer of Admission, the seat will be released and offered to the next applicant. The Reservation Fee paid will be forfeited.

2.4 Where an Installment Plan has been approved, the first installment as per the agreed Fee Schedule must be paid within the 30-day window to secure the seat. Subsequent installments follow the agreed schedule.

2.5 The 30-day seat confirmation window begins from the date of the Offer of Admission, not from the date of the initial application or Reservation Fee payment. The Academy will send a reminder on Day 20 and Day 28. However, the responsibility for timely payment rests solely with the student.

Note: The Reservation Fee of INR 1,999 is adjusted against the Course Fee at the time of enrolment. Students effectively pay INR 1,999 less on their Course Fee.

4. How to Pay

All payments can be made via the following modes:

Demand Draft / Cheque — drawn in favour of SWAMP Academy LLP (subject to clearance; seat confirmed only upon clearance)

Note: Cash payments are not accepted. Do not make payments to any individual. Only use the official bank account and payment links shared by The SWAMP Academy in writing.
